Eviction day 2 – 19th August, 4PM…(TOMORROW!)

Good day, good friend,

The National Trust have given ‘persons unknown’ till 4pm 19th August 2009 to leave Hackhurst Farm, Abinger Hammer based on an Order issued from Guildford County Court, dated 13th August 2009.

As we operate as real men under the Law, this order has no lawful authority over us.  It involves two soulless corporations, ‘The National Trust’ and ‘persons unknown’, which have no rights under the Law.

At a hearing relating to Tyting Farm earlier this year, David Shayler swore under oath and before God to his statement that as Jesus Christ he has the authority of the Law, before Mr Justice Reid, who heard the case of The National Trust versus Persons Unknown on 12th August 2009.  At no point did Mr Justice Reid challenge the lawful authority of David Shayler’s statement that he has the authority of the Law.

The authorities have no lawful authority to interfere in our enjoyment of life.  An Englishman’s home is, after all, his castle.  In addition to this, we have not harmed the rights of any man. 

Due to the nature of The Common Law, we are hereby giving notice that any man who infringes our rights will be held to account under the Law and be liable to pay compensation, an unlimited fine, imprisonment and being declared a ‘dead man’.

The reason we are refusing to leave tomorrow is as follows:

  • None of the paperwork issued to us is signed, it has no lawful or legal authority.
  • We have nowhere else to stay -  in other words we will be homeless.

Until there is a lawful claim to the property by a man or woman and a real dialogue is started about a smooth transition — or perhaps even hear what we vision for the site here — we intend to stay put.  Magna Carta is on our side.

The National Trust has no lawful claim to the property for three reasons:

  • because it is a legal fiction (It is a corporation – a souless entity)
  • because this land is a free land, as stated in Common Law and constitutional law, and
  • because no man has made a counter-claim to this property under the Law

In addition, we point out the following:

1. Highlight the errors on the paperwork that was sent to us on the 14th August, 2009 :

But when you look at paragraph 1. there is no date…

Paragraph 1

It simply says.. “1. The defendant give the claimant possession of Hackhurst Farmhouse, Hackhurst Lane, Abinger Hammer in Surrey as more particularly shown edged red on the plan attached to this order.”

No mention of a date.

If we are meant to leave by the date they state in paragraph 1 and there is no date, we cannot be in breach of the order.  As they can only authorise a bailiff to come and evict us after the date has passed then they can have no authority to proceed.  Have another look at this…

So what lawful authority does this Notice have (which appeared this afternoon)?

  • Let us first point out that giving us 24 hours to get our stuff out of the house and find another place to live is totally unreasonable.
  • The order is unsigned.  Under the Law, it therefore holds no validity over us as free men and we can effectively ignore it.  It seems that nobody feels injured enough to bother to put their name to it.

2. Any man or woman that violates our order tomorrow will have charges brought against them under common law.

  • Each man or woman will be given a disclaimer and their name will be taken in case of a breach of the law.
  • Each individual man or woman involved will be prosecuted for any offense they may commit. (In the case of the bailiffs this could be unlawful harassment or assault, or in the case of the police, unlawful arrest.)
